When a loved one abroad suddenly goes missing, and you later receive a call from China informing you that they have been criminally detained, the world seems to collapse in an instant. Distance, language barriers, and an unfamiliar legal system—everything leaves you feeling helpless and terrified.

But stay calm. In China, the law clearly stipulates the rights of foreign citizens and sets forth corresponding legal procedures. The key lies in taking the right actions within the golden window of time.

 

Step 1: Verify Information and Stay Calm

 

According to Chinese law, law enforcement authorities must notify the detainee’s family or the embassy/consulate of their home country in China within 24 hours after taking compulsory measures. If you receive a call from an official source, be sure to note the following information:

  •   The name and specific address of the law enforcement agency where the detainee is being held;
  •   Contact information of the handling police officer;
  •   The alleged charges against the detainee (if disclosed).

At the same time, contact your country’s embassy or consulate in China immediately. The embassy can provide consular assistance, including confirming the detainee’s condition, recommending reliable lawyers, and arranging visits when necessary.

 

 Step 2: Immediately Hire a Professional Lawyer

 

In China, during the criminal investigation phase (before the procuratorate approves arrest), family members are generally not permitted to meet with the detainee. Only lawyers can enter the detention center to conduct meetings, understand the case, provide legal counsel, file complaints and accusations on behalf of the detainee, and prepare applications for changes in compulsory measures such as bail pending trial.

  1.  Only Chinese licensed lawyers have the right to intervene in a case during the investigation phase;
  2.  Local lawyers are familiar with the judicial practices and procedures of the specific region;

Remember: Do not attempt to seek “connections” through informal channels or bribe law enforcement personnel. This constitutes a serious crime under Chinese law and will only worsen your loved one’s situation.

If you are overseas, you do not need to fly to China immediately. You can retain a lawyer through the following methods:

Notarization and Authentication at the Embassy/Consulate: Have documents such as your power of attorney and proof of relationship notarized and authenticated at the Chinese embassy or consulate in your country of residence.
